MandaFacil Terms and Conditions

These Terms and Conditions govern the use of the platform MandaFacil and the services provided by MandaFacil, Inc., a US company registered in the state of Delaware, with registered office at:

MandaFacil, Inc. collaborates with Eureka Moments Factory LLC and its Mexican subsidiary, Eureka Moments Factory S. de RL de CV, for cross-border sales, logistics, and support in Mexico. By accessing or using the MandaFacil website and services, you agree to these terms in full and authorize the exchange of data between MandaFacil, Inc. and Eureka Moments Factory, solely for the purpose of fulfilling the services.

1. Nature of the service

MandaFacil is not a money transfer service, fund transfer service, or currency exchange. We do not carry out remittance transactions or convert currencies. Our service is limited exclusively to the purchase of physical goods for delivery in Mexico.

MandaFacil is a digital platform that allows people in the United States to purchase physical products for their family members or beneficiaries in Mexico, paying in dollars and with the option to pay in a lump sum or through financing, using platforms such as Klarna, Affirm, PayPal, Apple Pay, Google Pay, Stripe, among others.

Depending on the situation, MandaFacil can:

  • Act as an intermediary between the buyer and third-party sellers or marketplaces.

  • Buy products directly from suppliers and resell them through the platform.

  • Act as the buyer on behalf of the user, managing the entire acquisition, import, and delivery process.

Accordingly, MandaFacil may have a direct relationship with certain suppliers, manufacturers, or distributors, but does not guarantee that a formal relationship exists with all brands, sellers, or marketplaces listed on the platform.

2. Role of intermediation and distribution

MandaFacil operates under two main models:

a) Technological, logistical and financial intermediation

MandaFacil facilitates purchases between users and sellers located in Mexico or abroad, managing the payment, purchase, and delivery processes.

b) Direct sales and distribution

In some cases, MandaFacil may purchase products directly and offer them on its platform. In these situations, MandaFacil acts as the seller and assumes responsibilities associated with delivering the product to the end user.

In both cases, prices, availability, delivery times, warranties, and return policies depend on the type of model used, the supplier involved, and the logistics defined for each product.

3. Product Warranty

  • When purchasing through intermediaries, the warranty for each product is provided directly by the corresponding seller, supplier, or marketplace, in accordance with their policies and applicable Mexican legislation.

  • When MandaFacil acts as a direct seller, the platform may offer additional guarantees, which will be explicitly communicated on the product page or during the purchasing process.

In any case, MandaFacil guarantees that the buyer will receive the product in the promised conditions and timeframe, or will process a partial or full refund. In the event of noncompliance by the supplier, MandaFacil will intervene to ensure the user receives a fair solution, including the processing of returns, refunds, or warranty compliance, at MandaFacil's discretion.

4. Limitation of liability

MandaFacil will not be liable for indirect, incidental, consequential, or punitive damages arising from the use of the purchased products. MandaFacil's maximum liability, in all cases, is limited to the amount actually paid by the user on the platform, subject to our internal refund policies.

5. Jurisdiction and applicable legislation

This contract shall be governed by the laws of the United States, under the jurisdiction of the State of Texas. Additionally, and with respect to deliveries within Mexican territory, Mexican commercial law shall apply.

7. Messaging Terms and Conditions

General

By opting in to messages, you agree to receive recurring automated marketing communications and information from MandaFacil, Inc. to the telephone number provided. These messages may be sent via an automatic dialing system.

Message frequency may vary and MandaFacil, Inc. reserves the right to increase or decrease the number of messages sent, as well as to modify the sender, telephone number or short code from which they are sent.

Your mobile service provider may apply message and data charges. MandaFacil is not responsible for delays or undelivered messages.

Your consent to receive messages is not a condition of purchase.

Telephone operators

Operators are not responsible for delayed or undelivered messages.

Cancellation

You can cancel at any time by replying STOP or through a link included in the messages. After cancellation, you will receive a confirmation message and will not receive further communications unless you sign up again.
