General Terms and Conditions of the Extended Warranty Service
Through this Extended Warranty service agreement, the Customer may request and receive repair of the Product in the cases described herein.
FIRST SECTION
DEFINITIONS
For the purposes of this Agreement, the following terms shall have the meanings mentioned below, which may be used interchangeably in the plural and singular:
Assurant: Means Assurant, SA de CV
Service center: Means the natural or legal person authorized by Assurant to carry out repairs to the Products.
Price: It means the amount paid by the Client to Mercado Libre for the purpose of acquiring the Extended Warranty and which entitles the Client to the benefits thereof in accordance with the provisions of this Agreement.
Contract: Means this adhesion contract for the provision of Extended Warranty services.
Customer: Means the natural or legal person who acquires a Product.
Manufacturer's Warranty: Means the warranty policy issued by the manufacturer or marketer of the Product that establishes the terms and conditions under which the Product is guaranteed against structural or operational failures derived from materials, quality or workmanship, for the time indicated in said policy.
Extended Warranty: Means the activities and services performed by Assurant through Service Centers or other third parties to repair the Products or replace them with a new, identical or similar product as a replacement for the Product, provided that such Products have failed due to original defects in materials, quality, or workmanship, for a period beyond the Manufacturer's Warranty. The Extended Warranty is independent of the Manufacturer's Warranty. The Extended Warranty is governed by the General Application Criteria regarding Warranty Extensions issued by the Ministry of Finance and Public Credit, published in the Official Gazette of the Federation on July 20, 2006.
Platform(s): Means the website and mobile application managed by Mercado Pago and/or Mercado Libre.
Products): means the movable property(ies) of any of the segments indicated below that Mercado Libre markets and in relation to which, the latter and Assurant agree that they may be protected by the Extended Warranty:
- Mechanical, Electrical, and Electronic Equipment and Devices. (The extended warranty services covered by this document with respect to this type of Product may include repair or, if repair is not possible, replacement of the Product with a new one of the same or similar characteristics.)
- Components, Parts, Spare Parts, or Vehicle Parts. (The extended warranty services covered by this document with respect to this type of Product are limited to the replacement of the Product with another identical or similar new Product, which cannot be repaired.)
- Products in the international purchases category and included in those indicated in the previous paragraphs.
Free market: means DeRemate.com de México S. de RL de CV
Mercado Pago: means MP Agregador, S. de RL de CV, the company that manages the website mercadopago.com.mx and the mobile application “Mercado Pago”.
SECOND SECTION
STEPS TO FOLLOW TO MAKE THE EXTENDED WARRANTY EFFECTIVE
- Purchase of the Product. When the Customer purchases the Product on Mercado Libre, through its website www.mercadolibre.com.mx or its app, as well as the Extended Warranty, the Customer will receive an email from Mercado Libre with a link to the Platform, where they can access the service certificate confirming the purchase of the Product and Extended Warranty. The Customer must retain the original warranty policy from the Product Manufacturer at all times, which can be downloaded from the Platform.
- Service request. The Customer must access the Platform, go to the Insurance and Warranties section, open the "Your Purchased Protections" section, and select the Extended Product Warranty, where they will be informed of the procedure for claiming the Extended Warranty. Assurant will validate the data and information provided by the Customer and, if the claim is valid, will provide the Customer with the service order number, which must be provided to the Service Center, or, where appropriate, to the technician who visits their home, so that they can repair the Product. In the case of auto parts, the service order number will be used by the Customer to track the replacement of the defective auto part with a new one.
If the Customer cannot prove their status as a Customer and/or registration of the Contract and/or purchase of the Product, Assurant will be released from its obligation to provide the services related to the Extended Warranty.
- Repair in Service Centers (Does not apply to the Product category represented by Components, Pieces, Spare Parts or Parts of Motor Vehicles.). Through the Platform's chatbot, the Customer may formalize their claim requests to validate the Extended Warranty covered by this Agreement. Through this means, they will be provided with the details of the Service Center where they must deliver the Product for inspection and repair. The Customer must deliver the Product to the Service Center staff with all its parts and components. Likewise, the Customer must submit the extended warranty certificate. Assurant, through its Service Centers, will conduct a preliminary review of the Product and determine whether the Product defect is covered by this Agreement. If it is, Assurant, through its Service Center, will proceed to make the necessary repairs to ensure the Product's proper functioning as many times as necessary.
If, upon inspection, the Product determines that the defect is due to circumstances not covered by the Extended Warranty under this Agreement, Assurant will inform the Customer and return the Product with all its components and in the same condition as when it was received, if technically possible. Neither Assurant nor the Service Center will assume any liability in this event.
- Repair at the Customer's home (Does not apply to the type of Products represented by Components, Pieces, Spare Parts or Parts of Motor Vehicles). If the Product consists of a refrigerator, plasma TVs larger than 37 inches, washing machines, heaters, dryers or laundry centers, stoves and/or built-in ovens running on natural or LP gas, or if the condition and characteristics of the Product warrant it at Assurant's discretion, the repair may be performed at the Customer's home. This is provided that the Customer or a person of legal age is present at the time of the repair.
The Customer must deliver the Manufacturer's Warranty policy and the electronic receipt or ticket of purchase of the Product to the Service Center staff who visits their home, who will perform a preliminary inspection of the Product and determine if the defect is covered by this Contract. If covered, the Service Center staff will inform the Customer of the defect, as well as the aesthetic and physical condition of the Product, and will proceed to make the necessary repairs for the proper functioning of the Product as many times as necessary.
If the technician determines that the Product must be transported to the Service Center for repair, such transportation will be at Assurant's expense. For Customer security, the platform's chatbot will provide information on how to identify the Service Center personnel, including contact information, etc.
If the Product inspection determines that the defect is due to circumstances not covered by the Extended Warranty, Assurant will inform the Customer and, if applicable, return the Product with all its components and in the same condition as when received, if technically possible. Neither Assurant nor the Service Center will assume any liability in this case.
- Voltage Variation (Does not apply to the type of Products represented by Components, Pieces, Spare Parts or Parts of Motor Vehicles.). In the event that the Product covered by the warranty set forth in this Agreement is an electrical or electronic device and it suffers damage due to voltage fluctuations during the Manufacturer's Warranty, the Customer must first contact the Manufacturer to obtain evidence of the rejection of the voltage fluctuation claim and must subsequently report the fault to Assurant through the Platform's chatbot. If the diagnosis determines that the fault in the Product was indeed caused by voltage fluctuations, the Product will be repaired under the terms of sections 3 and 4 of this Section.
- Special rules for replacements in the case of the Product modality represented by Components, Pieces, Spare Parts or Parts of Motor Vehicles:
- A) Assurant is obligated to provide the Client, through a third party, with a new, identical or similar product as a replacement for the Product described in the purchase order.
- B) The Replacement Service will be provided only in the event that the Product stops working as a result of a manufacturer's defect or due to a failure during normal use.
- C) Assurant will not make any refund or disbursement for the replacement of the Product to persons or companies that are not designated as previously authorized by Assurant to provide the Replacement Service.
- D) The Replacement Service will apply only to new auto parts with a minimum of 6 (six) months of manufacturer's warranty.
- E) The replacement program for auto parts is valid for 12 (twelve) months from the expiration of the manufacturer's warranty without any possibility of renewal.
- F) Once the Product has been replaced, this Contract will be terminated.
- G) The replaced (salvage) Product will become the property of Assurant.
- Assurant's Maximum Liability. Assurant's maximum liability limit for the repair service covered by the Extended Warranty will be equivalent to the Product's characteristics at the time of purchase, without exceeding its value. This does not imply payment of any amount in cash or reimbursement to the Customer by Assurant. This applies with the exception of cases where the Product is not repairable under paragraphs 3 and 4 above, in which case, the Customer will be granted a replacement with a Product with identical or similar characteristics. In the case of the Auto Parts program, the replacement will always be made with a product with identical or similar characteristics, without exceeding the purchase price supported by the receipt or invoice.
The Parties agree that the rights and obligations established under this Agreement apply only to the Product described on the printed receipt motivating the contracting of the services provided for in this Agreement. Assurant will not be responsible for the Product if it is not collected by the Customer within 60 (sixty) calendar days following the date that Assurant and/or the Authorized Service Center indicate to the Customer for delivery of the repaired Product.
SECTION THIRD
EXCLUSIONS
Exclusions applicable to the segment of Products consisting of Mechanical, Electrical and Electronic Equipment and Appliances
The Extended Warranty for this product segment will not be applicable in the following cases:
a) To the extent that the Product is covered and within the Manufacturer's Warranty period.
b) If the Product has been used under conditions other than normal, or due to negligence, carelessness, abuse or mistreatment by the Customer in the use of the Product or its electrical source and/or its improper connection to other equipment, or when the Product has not been used in accordance with the instructions in the Product's user manual.
c) If the Product has been used for commercial or industrial purposes, for any profit-making purpose, or is intended to be used in production, transformation, marketing, or provision of services to third parties, or in any way for which the Product was not designed.
d) In additional accessories to the Product, such as cables, chargers, batteries, containers, speakers, or similar. The foregoing includes those incorporated into the Product by the Customer. In supplies, articles and/or materials for preventive and/or replaceable maintenance, such as batteries, seats, blades, tapes, cylinders, brake shoes, rubber, tubes, bulbs, hoses, lamps, water membranes, air filters, oil filters, water filters, fuses, belts, handles, bags, connectors, cables or accessories in general, as well as all types of consumables.
e) In those cases in which the validity of the Manufacturer's Warranty for the Products is less than 90 (ninety) calendar days counted from the date on which the corresponding Product was purchased.
f) Damage or breakdown of aesthetic components such as cabinets, frames, masks, defects in finishes, glass, scratched lenses, or any other aesthetic damage.
g) In case of total or partial theft of the Product.
h) In damage, breakdowns or malfunctions caused by events or conditions extrinsic to the Product, such as knocks, falls, getting wet or splashing.
i) In the case of fragmented, broken or damaged parts as a result of lack of maintenance or lack of appropriate levels of lubricants or coolants.
j) In repairs or parts covered by the manufacturer's Original Warranty or by the manufacturer, or by a Product recall program.
k) In cleaning, adjustments or preventive maintenance of the product.
l) When the Product has been repaired, intervened or altered by the Client and/or third parties not authorized by Assurant.
m) Damages or losses that have been a consequence of, derived from, or caused by the defect or malfunction of the Product.
n) If the Product has been exposed to climates, environments, substances, materials or agents that are not appropriate or that may be harmful to the Product, such as fire, intense heat, solvents, water, steam, earth, sand, pests or insects or mold.o) In case of normal deterioration due to use or wear.
p) For the restoration of programs, loss of data or information, caused by the failure of the Product, or for its repair or replacement.
q) Due to deficiencies in the quality of the installation of: i) Electricity supply, ii) Water supply, iii) LP or Natural gas supply, iv) Drainage and piping system v) Exhaust system for burning or combustion gases, from the place where the product is connected and/or installed.
- Exclusions applicable to the segment of Products consisting of Components, Pieces, Spare Parts or Parts of Motor Vehicles:
The Extended Warranty for this product segment will not be applicable in the following cases:
a) In the event that the damage presented by the Components, Pieces, Spare Parts or Parts of the Motor Vehicles has been caused by an incorrect installation or misuse of these.
b) Components, Parts, Spare Parts or Parts installed in commercial motor vehicles, taxis (public or platform), delivery and/or cargo vehicles A/B/C or D, utility vehicles or business vehicles (individual and/or legal entity).
c) Components, Parts, Spare Parts or Wear Parts of motor vehicles, such as maintenance parts, batteries, belts, spark plugs, brake pads, cables, pulleys, filters, lubricants, light bulbs, tires, keys, rims and the like.
d) In cases of theft or accidental damage to the Components, Pieces, Spare Parts or Parts of motor vehicles.
e) Components, Parts, Spare Parts or Remanufactured or Used Parts at the time of purchase.
f) Damage caused to other non-covered auto parts derived from the covered auto part.
g) Damage to an auto part not covered by the Extended Product Warranty.
SECTION FOUR
FINAL STATEMENTS AND CLAUSES OF THE CONTRACT
Assurant declares that this Agreement is NOT and does not constitute an insurance contract, and therefore, Assurant will not, at any time, compensate for damages or pay any cash compensation or benefits. To ensure the adequacy of the resources required to fulfill the obligations arising from this Agreement, Assurant maintains a reimbursement or excess of loss insurance policy operated by a legally operating insurance company in Mexico, which is fully in force.
The Client declares that he/she has acquired the Product covered by the Extended Warranty covered by this Contract, which he/she will use for personal, non-commercial or industrial purposes, nor for storage, use in production processes, transformation, marketing or provision of Services to third parties.
The Customer agrees that, by paying the Price for the purchase of the Product, he or she gives his or her consent to be bound by the provisions of this Agreement.
FIRST. Object. The purpose of this Agreement is the Extended Warranty, which is limited to the repair of the Product in accordance with Section Two of this Agreement.
During the term of the Extended Warranty, it will cover only those cases stipulated in the Manufacturer's Warranty, as well as those specifically established in this Agreement. In the event of any discrepancy between the Manufacturer's Warranty and this Agreement, the provisions of this Agreement shall prevail.
SECOND. Of the Service Centers. Service Centers are obligated by Assurant to respect and comply with the laws, regulations, official rules, and other provisions applicable to them, taking into account the nature of the services they provide.
THIRD. Of the repair. Assurant will be responsible to the Service Center for covering the cost of spare parts and labor required for the repair of the Product. When repairing the Product, the Service Center will use new parts and/or spare parts appropriate to the model and brand of the Product. Notwithstanding the foregoing, if new parts and/or spare parts are unavailable on the market, the Customer hereby authorizes Assurant to instruct the Service Center to repair the Product with equivalent, substitute, or refurbished spare parts, provided that the quality, features, and functionality are equal to or similar to the original. In all cases, the parts and spare parts must comply with applicable standards. Any replaced parts or spare parts will become the property of Assurant.
The Extended Warranty is independent of the Manufacturer's Warranty.
If the Customer does not pick up the Product on the date established by the Service Center or, failing such designation, if they do not do so within 30 (thirty) calendar days after said date, the Customer will be obligated to pay the Service Center directly the amount it charges for storage. Assurant will not be responsible for the Product after 60 (sixty) calendar days have elapsed from the agreed delivery date without the Customer having claimed it.
FOURTH. Assurant's Responsibility. The Client acknowledges and accepts that Assurant's liability under this Agreement ends in the following cases:
- Upon expiration of the Extended Warranty period established in the electronic receipt or purchase ticket of the Product.
- With the delivery of the repaired Product to your complete satisfaction.
- With the delivery of a replacement Product.
The Customer acknowledges that the provisions of this Agreement will not apply to other products purchased by the Customer.
The Client acknowledges and accepts that Assurant is solely responsible for the provision of services and the Extended Warranty contained in this contract and releases Mercado Libre from any liability that may arise regarding the subject matter of this Contract.
FIFTH. Price. The price paid by the Customer to Mercado Libre to acquire the Extended Warranty will entitle them to make it effective.
SIXTH. Consent. The Client agrees that, by making payment of the Price, he or she consents to each and every one of the terms and conditions of this Agreement and agrees to be bound by its terms.
SEVENTH. Other Obligations of the Client. In addition to any other obligations set forth in this Agreement, the Client must:
- Install, operate, and maintain the Product according to the installation, operation, and maintenance requirements outlined in the user instructions and under the Manufacturer's Warranty specifications.
- Present the required information and the Product with all its components to the Service Center. In the case of auto parts, the Customer must send the photographic evidence requested by Assurant.
- Pay the costs and assume the risks of transporting the Product, when these are not borne by Assurant.
- Refrain from using the Product for commercial or industrial purposes or using it for production, transformation, marketing or service provision to third parties, or placing it in commercial premises (e.g., offices, hospitals or businesses, even if they are family businesses).
EIGHTH. Other Obligations of Assurant. In addition to any other obligations set forth in this Agreement, Assurant agrees to:
- Be responsible to the Client for compliance with the Extended Warranty services; it is understood that Assurant assumes no liability for acts or events of the Service Center that are not specifically related to the contracted repair services and for which the Service Center is directly responsible to the Client.
- Have Service Centers perform repairs to the Product in accordance with the provisions of this Agreement.
NINTH. Validity. Unless otherwise provided, the provisions of this Agreement will take effect from the expiration date of the Manufacturer's Warranty and will remain in effect until the expiration of the Extended Warranty term, which will be specified on the electronic receipt or purchase ticket for the product.
TENTH. Rescission and termination. This Agreement shall be terminated when either party has breached any of its obligations under this Agreement or in the event of legal action. Such termination shall be effective by operation of law and without the need for any judicial declaration, upon prior written notice given (15) fifteen calendar days in advance.
The Client accepts that it will have the right to cancel the Extended Warranty and obtain a refund of the Price only if the cancellation request is made to Assurant by any means within 30 (thirty) calendar days following the acquisition of said Extended Warranty. After this period has ended, Assurant will be authorized but not obligated to return the Price of the Warranty to the Client, and in the event that it decides to return it, Assurant may deduct the amount equivalent to 20 % from the price of the same as late cancellation fees.
If the Customer returns any Product and Mercado Libre refunds the Price, the Extended Warranty will be void.
ELEVENTH. Subrogation. The Customer expressly acknowledges that if Assurant repairs the Product (through the Service Centers), it will be subrogated to any rights that the Customer or Mercado Libre may have with respect to the manufacturer or any third party. Assurant will assume any costs and expenses incurred in connection with the subrogation referred to in this Clause.
TWELFTH. Modifications. Assurant may propose modifications to this Agreement through the Platform. These modifications will be notified to the Client through the Platform or by email, clearly highlighting the modifications, at least 10 (ten) calendar days prior to the intended effective date. This is understood to mean that the Client may express their disagreement to Assurant in writing within the aforementioned period. Failure to do so will be deemed acceptance of said modifications.
THIRTEENTH. Notifications. For all purposes arising from this Agreement, Assurant's notices will be effective at the Client's registered address or the last address notified to the Client, or by email. The Client may send any notice to Assurant at the address set forth in this Agreement.
FOURTEENTH. Jurisdiction and Competence. The Client's rights are protected by the Federal Consumer Protection Law. For the interpretation, execution, and enforcement of this Agreement, the parties submit to the jurisdiction of the Federal Consumer Protection Agency and the laws and jurisdiction of the competent courts of Mexico City, regardless of the jurisdiction that may apply to them due to their domicile or any other circumstance.
FIFTEENTH. Privacy Notice. In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (the "Law"), Assurant, SA de CV ("Assurant") hereby notifies the data subject (the "Data Subject") that it will collect and receive personal information related to the Data Subject (hereinafter, the "Information"). Such information may include, among others, the following personal data: name, address, telephone number, and email address.
In accordance with the Law, Assurant informs and guarantees to the Holder that:
- The Owner's Information will be processed solely for the purpose of (i) fulfilling the purpose and purposes of the legal relationship between Assurant and the Owner in accordance with the provisions of the respective contract, (ii) communicating information on products and services, advertising and promotions of interest, as well as for the purposes of (iii) commercial prospecting.
- Fulfillment of the object and purposes of the legal relationship between Assurant and the Holder includes, but is not limited to, the issuance of extended warranty certificates, their administration, claims processing, support services, customer service, litigation administration, risk assessment and evaluation, and the repair, replacement, and delivery of products.
- Assurant may share Data Subject Information with domestic or foreign entities that are part of Assurant's corporate group or that collaborate with Assurant to process the information for the purposes described in this Privacy Notice.
- If Assurant shares Data Subject Information, it will ensure that such information sharing is carried out under a confidentiality agreement and will guarantee that the receiving entity has information protection mechanisms equivalent to those established by Mexican law.
- Assurant will not use the Data Subject's Information for purposes other than those set forth in the Privacy Notice. In the event that Assurant needs to use said Information for purposes other than those set forth in the contract and in this privacy notice, it must send the Data Subject a new privacy notice for such purposes. Any changes to the Privacy Notice will be notified to the Data Subject (i) through the website www.assurantsolutions.com/mexico/, (ii) in writing to the Data Subject's last registered address, (iii) by telephone, where the Data Subject will be informed how to access the new Privacy Notice, or (iv) by email to the Data Subject's registered address for such purposes.
- Assurant maintains and will maintain the highest standards and procedures for the physical and/or electronic protection of Data Subject Information. Likewise, it will restrict access to Data Subject Information to individuals not directly involved in activities related to the fulfillment of the respective contract or the processing of personal data in accordance with this privacy notice.
- The Data Subject may exercise their rights of access, cancellation, rectification and objection to the processing of their personal data, or revoke their consent for the processing of their personal data by sending their request via email to datospersonales@assurant.com. Such request must contain at least: (i) the name of the Data Subject, (ii) contact information, (iii) a description of the personal data for which they are requesting to exercise their rights, (iv) a statement of the rights to be exercised, and (v) additional information to locate their personal data.
In accordance with the provisions of the Law, the Data Subject grants, by entering into the respective contract and paying the corresponding Price, his or her consent to Assurant processing his or her personal, financial, and/or sensitive data in accordance with the terms of the aforementioned Privacy Notice.
